The Social Security Disability rules can be as complicated as your medical history! 

Unfortunately, researching the disability process is difficult, and understanding their process is even harder!  Nearly every rule could have an exception that could make the difference between an allowance and a denial. Working with a knowledgeable and well-experienced disability advocate can give your case the boost it needs to get approved faster. 

#1 Rule Communication

We often speak with clients who have previously filed for disability with a law firm. A common complaint is that they never communicated with their advocate during the entire process, except on the day of the hearing. There was no feedback, no updates on the case, and most importantly, no guidance on the strength of their application. 

Just last week, a client told me that it wasn’t until after the hearing that he learned his doctor had never documented anything about his hand deformity. As a result, the judge had no basis to assess the severity of the condition or the related limitations. Since the hearing was conducted over the phone, the judge could not see the client’s hand, and even worse, his advocate was unaware that this was his primary disability.

The more an advocate knows about your health and conditions, the better they can advocate for you. Unfortunately, many firms delegate responsibilities to paraprofessionals and support staff, which can lead to essential information being overlooked. Direct communication with the person handling your case allows both parties to understand what is needed from each other. Your advocate should be routinely updated on your medical care, health, and daily challenges and clients should be informed about how the case is progressing, what the doctors are reporting, and how to address any weaknesses in their application. This ongoing communication is crucial for effective representation.

#2 Rule Efficiency

Unfortunately, disability advocates are compensated more when cases take longer to resolve. This often leads some firms to let cases linger until they are forced to address them. In their view, minimizing effort and staff time results in higher profits. Ur Disability Rep believes there is a better way. We emphasize the importance of reviewing records, preparing agreements, staying current on your case, and resolving it promptly. This approach not only allows us to take on additional cases but also helps your case resolve faster, ensuring you can keep food on the table.

As a potential disabled person, you should have a sense of how aggressively your case will be pursued. You are hiring an advocate, and you deserve someone who will work diligently for you, not just monitor the case. Your advocate should communicate with you, review your records, and understand the regulations used by the Social Security Administration (SSA). Simply put, they should be the most knowledgeable and prepared person involved in your case and advocate for your case. Your advocate should earn your trust and your money, not merely take it.

#3 Rule Experience

Using an experienced disability advocate is our third rule. The advocate should help you communicate with your doctors to ensure your medical records are accurately documented. The advocate should also be educated on new changes that could affect your case. Finally, your advocate should be proactive in strengthening your case.
